#Zoom: Second round for the cession of 53 going concerns selling cosmetic and hair-care products, located throughout France

As part of the judicial liquidation of the French company The Body Shop France, the firm of Asteren, reprsented by Julia Ruth and Charles-Axel Chuine, are looking for buyers for 53 going concerns selling cosmetic and hair-care products, and the company’s stocks. After launching an initial tender, a second round is being organized. The deadline for offers has been set at 5 p.m. on October 9, 2024.

In a ruling dated July 17 2024, the commercial court of Paris converted receivership proceedings into the judicial liquidation of the company The Body Shop France, which sells cosmetic and beauty products under the brand name The Body Shop.

It is in this context that the liquidators are looking for buyers for 56 going concerns located throughout France, together with stocks. These businesses currently operate all forms of trading activities in relation to cosmetic and hair-care products.

These going concerns are made up of leases, clients, and any agreements and documents associated with the business of the company The Body Shop France, together with all material and movable assets as listed by the auctioneer, with the exception of those assets liable to claim, rolling stock and equipment. Your attention is drawn to the fact that the brand name THE BODY SHOP is not owned by THE BODY SHOP FRANCE.

It also specified that, in order to protect their rights in relation to the CGEA Ile de France (AGS), the employees are currently being made redundant on economic grounds, such that the buyer will be responsible for preferential re-employment  rights.

The deadline for offers has been set at 5p.m. on October 9 2024, to be received by Maître Stéphane Van Kemmel, Enforcement Officer for the commercial court of Paris.

Given the number of going concerns involved, three hearings have been set for the opening of tenders, one of which will be dedicated to stocks:

• Session 1 & 2 : Hearing for the opening of tenders on Thursday October 10 2024 at 2 p.m.
• Session 3 (stocks): Hearing for the opening of tenders on Thursday October 10 2024 at 2.30 p.m.
